Digital and SaaS delivery
Software and SaaS access are delivered electronically. Delivery is considered complete when access is granted, credentials are issued, or the service engagement is confirmed.
Agreement to these terms.
By purchasing or using services from Bernier Tech Ltd, you accept these Terms and Conditions. In addition, the Privacy Policy and Refund Policy are incorporated into these terms.
What is covered here.
These terms apply to digital products, software licenses, SaaS services, and professional FinOps advisory engagements. They cover purchase, delivery, use, cancellation and liability, and they apply alongside any platform-specific checkout terms from Lemon Squeezy, Stripe or Fastspring.
Advisory and consultancy
Professional services are delivered on a best-effort basis. Customers may need to provide access, documentation, and cooperation for effective service delivery.
Customer responsibilities
Customers must use services in accordance with applicable law, maintain secure access credentials, and ensure their own cloud and business environments are compliant with relevant regulations.
Ordering and billing.
Payment
Payments are processed by third-party checkout platforms such as Lemon Squeezy, Stripe, or Fastspring. Their payment, refund and dispute policies apply in addition to these terms.
Service commencement
Service begins immediately upon purchase for digital products and SaaS, or when a service engagement is confirmed. This may include account activation, license delivery, or the start of an advisory engagement.
License terms
Purchased software access is provided on a non-exclusive, non-transferable basis for the purposes described in the purchase confirmation.
What we promise, and what we do not.
- Bernier Tech Ltd delivers software, SaaS access, reports and advisory guidance. We do not guarantee specific cost savings, financial outcomes or business results.
- Any estimates, projections or recommendations are illustrative and should not be taken as professional financial or tax advice.
- Customers are responsible for decisions made based on delivered services and for the implementation of recommendations.
Data handling and privacy.
Personal data provided through the purchase or service process is handled according to the Privacy Policy. You agree that we may use your personal data to fulfil orders, provide services and manage our business relationship.
How refund rights apply.
Refunds and cancellations are governed by the Refund Policy. Digital products and services are generally non-refundable after delivery or access has been granted, except where statutory consumer rights apply.
Buyer duties.
- Provide correct and complete information during purchase and service delivery.
- Keep account credentials secure and promptly report any suspected unauthorised access.
- Use purchased services lawfully and in line with any applicable cloud provider or platform provider terms.
- Cooperate with Bernier Tech where access, documentation or approval is needed to deliver services.
Limits of liability.
To the extent permitted by law, Bernier Tech Ltd is not liable for indirect, special, incidental or consequential losses, including lost profits, lost savings, or business interruption. Our total liability for any claim arising from these terms is limited to the amount paid for the specific product or service giving rise to the claim.
Nothing in these terms limits liability for death or personal injury caused by our negligence or any other liability that cannot legally be excluded.
Applicable law and jurisdiction.
These terms are governed by the laws of the United Kingdom, except where local mandatory law provides otherwise. Any dispute arising from these terms will be subject to the exclusive jurisdiction of the UK courts, unless the applicable law requires a different forum.
