Professional services are delivered on a best-effort basis. Customers may need to provide access, documentation, and cooperation for effective service delivery.
Customers must use services in accordance with applicable law, maintain secure access credentials, and ensure their own cloud and business environments are compliant with relevant regulations.
Payments are processed by third-party checkout platforms such as Lemon Squeezy, Stripe, or Fastspring. Their payment, refund and dispute policies apply in addition to these terms.
Service begins immediately upon purchase for digital products and SaaS, or when a service engagement is confirmed. This may include account activation, license delivery, or the start of an advisory engagement.
Purchased software access is provided on a non-exclusive, non-transferable basis for the purposes described in the purchase confirmation.
Personal data provided through the purchase or service process is handled according to the Privacy Policy. You agree that we may use your personal data to fulfil orders, provide services and manage our business relationship.
Refunds and cancellations are governed by the Refund Policy. Digital products and services are generally non-refundable after delivery or access has been granted, except where statutory consumer rights apply.
To the extent permitted by law, Bernier Tech Ltd is not liable for indirect, special, incidental or consequential losses, including lost profits, lost savings, or business interruption. Our total liability for any claim arising from these terms is limited to the amount paid for the specific product or service giving rise to the claim.
Nothing in these terms limits liability for death or personal injury caused by our negligence or any other liability that cannot legally be excluded.
These terms are governed by the laws of the United Kingdom, except where local mandatory law provides otherwise. Any dispute arising from these terms will be subject to the exclusive jurisdiction of the UK courts, unless the applicable law requires a different forum.
